SB 29 (County Clerk liability) was heard in Senate Committee on Corrections, Criminal, and Civil Matters on Tuesday, January 5, 2010 at 9:00 a.m. Authored by Sen. Connie Lawson (R-Danville), the bill passed unanimously 10-0. SB 29 provides that a circuit court clerk is not personally liable for acts or omissions in the performance of the clerk's duties absent gross negligence or intentional disregard of the responsibilities of the office of clerk. SB 29 will proceed to 2nd Reading in the Senate.
Meantime, HB 1044 (County Clerk liability), authored by Rep. Nancy Michael (D-Greencastle) was heard Wednesday, January 6, 2010 in the House Committee on Local Government. It passed out of committee 11-0.
