Clerks' Liability Bills Pass Through Committee Hearings

SB 29 (County Clerk liability) was heard in Senate Committee on Corrections, Criminal, and Civil Matters on Tuesday, January 5, 2010 at 9:00 a.m. Authored by Sen. Connie Lawson (R-Danville), the bill passed unanimously 10-0. SB 29 provides that a circuit court clerk is not personally liable for acts or omissions in the performance of the clerk's duties absent gross negligence or intentional disregard of the responsibilities of the office of clerk. SB 29 will proceed to 2nd Reading in the Senate.

The Association of Indiana Counties (AIC) has produced a joint podcast with other associations that have concerns about property tax caps being placed in the constitution. The Indiana General Assembly may vote on the amendment this week. Guests in this edition of AIC Update are: David Bottorff, Association of Indiana Counties Executive Director; Matt Greller, Indiana Association of Cities and Towns Executive Director; and Katrina Hall, Indiana Farm Bureau Tax and Local Government Specialist.

In this edition we discuss the unintended consequences of HB 1004. A hearing was held on the bill yesterday (December 9) with an Indiana House of Representatives' committee. Guests: David Bottorff, AIC Executive Director; Indiana County Assessors' Association President Judy Sharp, Monroe County Assessor; and Indiana County Assessors' Association Vice President Stacy O'Day, Allen County Assessor, attended the hearing and discuss their thoughts on the bill in its current form.

Allen County: Enhancing Services with Social Media

Allen County Government is on the forefront of Indiana local governments that are effectively using social media tools to enhance the services they offer citizens. Allen County Recorder John McGauley is not the only government official in his county to use these tools. He does, however, have an interesting perspective because of his background as a journalist.

Indiana Attorney General Joins Indiana County Recorders to Fight Property Fraud

The Indiana Attorney General has joined the Indiana Recorders' Association to alert homeowners about a potential scam that could force them out of their homes. Attorney General Greg Zoeller says some Indiana citizens have fallen victim to property fraud. In most cases, it involves homes that no longer carry a mortgage. Zoeller says the perpetrators will file a deed for property that belongs to someone else.
